Terms of Service — ClientTrackPro

These Terms of Service (“Terms”) govern your access to and use of the ClientTrackPro mobile application (“App,” “Service”), operated by Terance Austin, doing business as No Boss Network (“we,” “us,” “our”). By downloading, accessing, or using ClientTrackPro, you agree to be bound by these Terms. If you do not agree, do not use the App.
1. Acceptance of Terms
By creating an account, downloading, or using ClientTrackPro, you confirm that you are at least 18 years old (or the age of legal majority in your jurisdiction) and have the authority to enter into these Terms on behalf of yourself or the business you represent.
2. Description of Service
ClientTrackPro is a business management application designed to help service-based businesses manage clients, families, attendance, payments, invoices, scheduling, and related business operations. Features and availability may vary based on your subscription tier.
3. Accounts and Eligibility
ClientTrackPro does not currently require account registration or login. All data is stored locally on your device (and in your personal iCloud account if iCloud sync is enabled by you). You are solely responsible for maintaining the security of your device and any data entered into the App.
4. Subscriptions and Billing 4.1 Subscription Plans
ClientTrackPro offers the following auto-renewable subscription plans through Apple’s In-App Purchase system:
Pro Monthly — $14.99 per month, with a 7-day free trial
Pro Yearly — $149.99 per year, with a 7-day free trial
4.2 Free Tier
A free version of the App is available with limited functionality (currently limited to 5 client/family profiles). Upgrading to a paid subscription unlocks unlimited clients and all supported business types.
4.3 Billing and Auto-Renewal
Payment is charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period, at the price you agreed to at signup.
4.4 Free Trial
If a free trial is offered, payment will not be charged until the trial period ends, unless you cancel before the trial expires. Any unused portion of a free trial is forfeited when you purchase a subscription during the trial period, where applicable.
4.5 Managing and Canceling Subscriptions
You can manage or cancel your subscription at any time through your Apple ID account settings. Cancellation takes effect at the end of the current billing period; no partial refunds are issued for unused time.
4.6 Refunds
All purchases are processed by Apple. Refund requests are subject to Apple’s refund policies and must be submitted directly through Apple, not through us. We do not have the ability to issue refunds directly.
5. Your Data
ClientTrackPro does not collect, transmit, or sell your personal data to us or to any third party. All information you enter — including client, family, payment, route, and business data — is stored locally on your device using Apple Core Data. If you enable iCloud sync, your data is stored in your personal iCloud account under Apple’s own terms and privacy practices. We do not have access to, and cannot recover, data stored solely on your device or in your personal iCloud account.
You are solely responsible for backing up your data. We strongly recommend enabling iCloud sync or periodically exporting your data if that feature is available.

6. Acceptable Use
You agree not to:
Use the App for any unlawful purpose or in violation of any applicable local, state, national, or international law
Attempt to reverse engineer, decompile, or otherwise extract the source code of the App, except as permitted by law
Use the App to store or process data you do not have the legal right to collect or manage (e.g., data collected without the consent of the individuals involved, where required)
Interfere with or disrupt the integrity or performance of the App
• Misrepresent your identity or affiliation when contacting support
You are solely responsible for ensuring your use of the App complies with all laws applicable to your business, including any data protection, privacy, or child-safety laws relevant to the individuals whose information you store in the App (e.g., students, clients, or families).
7. Intellectual Property
ClientTrackPro, including its design, features, branding, and underlying code, is the property of Terance Austin / No Boss Network and is protected by copyright, trademark, and other intellectual property laws. These Terms do not grant you any ownership rights in the App. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for your personal or business purposes in accordance with these Terms.
Any third-party open-source software incorporated into the App remains subject to its respective license terms.
8. Anti-Cloning / Protection of Original Work
Except where prohibited by applicable law, you may not copy, reproduce, reverse engineer, decompile, scrape, or create a derivative or substantially similar competing application based on ClientTrackPro’s protected original expression, including its source code, trademarks and branding, graphics and icons, original screen layouts, and documentation. This clause protects our original creative and technical expression as recognized under copyright and trademark law; it does not restrict others from independently developing applications that serve a similar business purpose or industry.
9. Disclaimers
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DATA LOSS WILL NOT OCCUR.
ClientTrackPro is a business management tool. We are not responsible for business decisions, billing errors, missed payments, scheduling conflicts, or other operational outcomes resulting from your use of the App.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL TERANCE AUSTIN OR NO BOSS NETWORK BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, REVENUE, OR PROFITS, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
11. Indemnification
You agree to indemnify and hold harmless Terance Austin and No Boss Network from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your use of the App, your violation of these Terms, or your violation of any rights of a third party.
12. Termination
We reserve the right to suspend or discontinue the App, or your access to it, at any time, with or without notice, including for violation of these Terms. Upon termination, your right to use the App ceases immediately. Sections of these Terms that by their nature should survive termination (including Sections 5, 7, 8, 9, 10, and 11) will survive.
13. Changes to These Terms
We may update these Terms from time to time. Material changes will be reflected by an updated “Last Updated” date. Continued use of the App after changes take effect constitutes acceptance of the revised Terms.
14. Governing Law
These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict of law principles, except where superseded by Apple’s App Store terms or applicable consumer protection law in your jurisdiction.
15. Apple-Specific Terms
ClientTrackPro is distributed through the Apple App Store and is subject to Apple’s Standard End User License Agreement (EULA) and Apple Media Services Terms and Conditions, in addition to these Terms. Apple is not a party to these Terms and has no obligation to provide support or maintenance for the App. In the event of any conflict between these Terms and Apple’s terms regarding in-app purchases and subscriptions, Apple’s terms govern the purchase transaction.
16. Severability
If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
17. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding your use of ClientTrackPro, and supersede any prior agreements or understandings, whether written or oral, relating to the subject matter herein.
